There has been a conflict over the UK regulations and the European Court of Justice’s views on the matter of sick leave. In the case, one of the employees had asked for annual leave whilst already on sick leave, but HMRC did not allow it. Also, three other employees were dismissed from service while they were on sick leave, and they had not taken any holiday during their period of illness. They asked for payment in lieu of their outstanding holidays for that period but were refused by HMRC on the ground that they were on sick leave. The House of Lords is yet to give it decision in the final stage of this legal battle of Stringer v. HMRC.
The Employment Tribunal and Court of Appeal had decided in favour of the employer, but when the case came before the ECJ, it decided otherwise, holding that workers accumulate holidays for four weeks in a year throughout any duration of illness absence and they must be permitted to take this leave on return.
